Terms and conditions
Last updated: 16 October 2026.
These terms govern the services provided by Serverary SIA, registration No. 40203789294 ("Serverary"). The privacy policy is published with these terms. Contact: support@serverary.com.
1. The agreement
An order placed through Serverary, or accepted by Serverary in writing, forms a contract on these terms. The customer confirms that the account information is accurate and that the person placing the order is authorised to bind the customer. The language of the contract is English.
2. Services
Serverary provides virtual private servers and related hosting services. Domain-name registration, when offered, is also covered by section 9. The description, price, and billing period shown at the time of order form part of the contract.
Serverary does not warrant that a service will be uninterrupted or free of error. Planned maintenance, and faults in networks outside Serverary's control, may interrupt a service. The customer is responsible for the data and software placed on a server, and for maintaining the customer's own backups. Serverary does not back up a customer server unless the product description states that backups are included.
3. Accounts
The customer shall keep login credentials confidential and shall notify Serverary promptly of any suspected misuse. Serverary may refuse a registration, or close an account, that is incomplete, misleading, or used in breach of these terms.
4. Invoices and payment
Fees are charged in euro. A renewal invoice is issued 14 days before the renewal date and is due on that date. Serverary does not charge a late fee. Payment is made by the methods offered at checkout. Where the customer has stored a card for automatic payment, Serverary may charge that card on or shortly before the due date and will send the payment notices configured for the account.
Payment reminders are sent 7 days before the due date, on the due date, and 3 days after the due date.
5. Suspension and cancellation by Serverary
If an invoice remains unpaid on the due date, Serverary suspends the related service on that date. If the invoice is still unpaid 7 days after suspension, Serverary cancels the service and sends a cancellation notice. Serverary may suspend or cancel a service without that notice period where the customer breaches the acceptable-use rules, where the law requires it, or where the service is used to harm Serverary or any other person. Where the law permits, Serverary will notify the customer and allow a reasonable opportunity to remedy a breach that is capable of remedy.
6. Cancellation by the customer
The customer may cancel a service from the client area. Cancellation takes effect at the end of the period already paid. Fees for the current prepaid period are not refunded, except where section 7 or mandatory law requires a refund. Cancellation does not release the customer from charges that are already due.
7. Withdrawal by consumers
A consumer in the European Union or the European Economic Area may withdraw from a distance contract within 14 days of its conclusion, without giving a reason. Notice of withdrawal should be sent to support@serverary.com. Serverary will refund the sums paid for the withdrawn contract within 14 days, using the same means of payment where practicable.
If the customer asks Serverary to begin the service during the withdrawal period, the customer pays a proportionate amount for the period used if the customer later withdraws. If the customer gives prior express consent to immediate performance, and acknowledges that the right of withdrawal is lost once the service has been fully performed, that right ends when performance is complete. This section does not limit any right that mandatory consumer law preserves.
8. Acceptable use
The customer shall not use a service, or permit it to be used, in breach of law, to infringe the rights of any person, to send spam or phishing messages, to host or distribute malware, to attack, scan, or disrupt systems or networks, or to store or distribute child sexual abuse material. The customer shall not use a service in a manner that materially degrades the platform for other customers. Serverary may review traffic and content only to the extent required to enforce this section, to protect the platform, or to comply with law.
9. Domain names
Where Serverary offers a domain name, registration and renewal are also subject to the rules of the relevant registry and registrar. A domain that has been registered or renewed is generally not refundable, because the registry has already performed the registration. The customer is responsible for the accuracy of the registrant details and for renewal before expiry. Serverary may decline a domain request that it cannot lawfully complete.
10. Liability
Nothing in these terms limits liability that cannot be limited under the law of Latvia or the European Union, including liability for fraud or for death or personal injury caused by negligence. For any other claim by a customer who is not a consumer, Serverary's total liability in a contract year is limited to the fees paid by that customer for the affected service during the 12 months before the claim. Serverary is not liable for loss of profit, loss of data, or indirect loss, except where the law does not permit that exclusion. The customer is responsible for the customer's content and for claims arising from use of a service in breach of these terms.
11. Changes
Serverary may update these terms by publishing the revised version. A change that materially affects price, renewal, or the customer's rights will be notified by email before it applies to a renewal. A customer who does not accept a material change may cancel the affected service before renewal, with effect at the end of the prepaid period.
12. Law and disputes
These terms are governed by the law of Latvia, and the courts of Latvia have jurisdiction. A consumer may also bring proceedings in the courts of the European Union member state in which the consumer is domiciled, and the mandatory consumer protections of that country continue to apply. A consumer may use the dispute-resolution facilities made available under European Union law, and may contact the Consumer Rights Protection Centre of Latvia (Patērētāju tiesību aizsardzības centrs).
